im trying to create a diagrid of my surface structure. and below it another paneling system to follow the structure. however the exterior diagrid tends to intersect with the surface rather than follow it

It follows the surface, it just hasn’t enough definition in that spot. Either dial up the divisions in the relevant direction of the surface (u or v) or you might want to look into adaptive diamond grids:
