If you connect a panel to the split surface result does it say invalid brep?
Try doing in manually in Rhino. You can split a surface with curves as the splitting object.
Also note that in real life the terrain would be carved out and planarized for the roads. Meaning roads are not actually curved to the terrain. They do have a slight transversal curving to account for drainage.
