I just found that 3dmbak files will be created with savesmall not with a regular save.
Regardless of the checkbox in options.
Can Anyone confirm this?

Do you mean that the 3dmbak file is not created when you Save but is when you use Save Small from the File menu? Or do you mean that the 3dmbak is saved as a small version without the render mesh?
In testing here, the 3dmbak is created when saving and is the version of the file (including save small or not) at the time of running Save. So it appears to be working correctly but let me know if I misunderstood the issue.

I see I was not clear.
Options ->. files -> creating 3dmbaks is UNchecked ( I do not wat 3dmbaks to be created)
I have a file and save it. -> no 3dmbak is created
I have that same file and run “SaveSmall” command -> the 3dmbak is created.
All of this is on my Desktop , or another folder on my drive, step by step screenshots:
